Ltd. - INOX JEWELRY INDIA Division ("INOX JEWELRY INDIA", "WE" or "US" as the case may be) provides the service (defined below) to you, subject to the following Terms of Use ("YOU" OR "USER AGREEMENT"), which may be updated by us from time to time without notice to you. You can review the most current version of the User Agreement at any time at: https://inoxjewelry.in/pages/terms-conditions In the event of we offering other services, such services may be governed by different terms of use and in such cases this User Agreement shall not apply to such other services if and to the extent expressly excluded by such different terms of use. INOX JEWELRY INDIA may also offer other services from time to time that may be governed by different terms of use. This User Agreement does not apply to such other services that are governed by different terms of use. By viewing, visiting, using, or interacting with this Site or with any banner, pop-up, or advertising that appears on it, you agree and bind yourself to all the provisions contained in this User Agreement and the Privacy Policy of this Site.  

3.DESCRIPTION OF SERVICE 

3.1 This Site provides access pricing, sales, news, contests and other information services related to stainless steel and alternative material jewelry. Certain Services available on this Website are for the use of Members only. 

3.2 Unless explicitly stated otherwise, any new features those enhance or augment the current service, including the release of new INOX JEWELRY INDIA properties, shall be subject to this User Agreement. You understand and agree that the service is provided "As-Is" and that INOX JEWELRY INDIA assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. 

3.3 Unless expressly stated otherwise, no information presented in the service or in connection with any products and services forming part of the service shall be deemed as a binding offer by us but may constitute an invitation for you to place an order. In respect of contracts for the products and services which are made available as part of the service, these shall be deemed concluded when we have accepted your order for the same or have provided you with the product or service pursuant to your order. 

3.4 Content that is considered obscene or opposed to public policy under Indian law is strictly forbidden on the Site. 

4. MEMBER ACCOUNT, PASSWORD AND SECURITYYou will receive a password and account designation upon completing the service's registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to:

1. Immediately notify INOX JEWELRY INDIA of any unauthorized use of your password or account or any other breach of security, and
2. Ensure that you exit from your account at the end of each session. INOX JEWELRY INDIA cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 4.

5.YOUR REGISTRATION OBLIGATIONS In consideration of your use of the service, you agree to: 

1. Provide true, accurate, current and complete information about yourself as prompted by the service's registration form (such information being the "registration data") and

1. Maintain and promptly update the registration data to keep it true, accurate, current and complete at all times. If you provide any information that is untrue, inaccurate, not current or incomplete, or where INOX JEWELRY INDIA has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, INOX JEWELRY INDIA has the right to suspend or terminate your account and refuse any and all current or future use of the service (or any portion thereof) without any liability to you. We are concerned about the safety and privacy of all our users. INOX JEWELRY INDIA does not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18, you may use INOX JEWELRY INDIA only with the involvement of a parent or guardian.  

6.UNDERTAKINGS BY THE USER 

6.1 You agree to not use the Site to: 

1. upload, post, email or otherwise transmit any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable or contrary to public interest, public order or national harmony in all relevant jurisdictions;

1. disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges or to utilize the service on an AS IS basis as provided by us;

1. interfere with or disrupt the Website or servers or networks connected to the Website, or disobey any requirements, procedures, policies or regulations of networks connected to the Site;

1. intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the Indian securities, exchange control and other regulatory authorities, any rules of any Indian securities exchange and any regulations having the force of law;

1. commit any fraudulent or unlawful act, whether in relation to any third party provider of products and services on the Service or otherwise;

1. use any product or service available on the Site/services for commercial purposes of any kind, or (ii) advertise or sell any products, services or otherwise (whether or not for profit), or solicit others (including, without limitation, solicitations for contributions or donations) or use any public forum for commercial purposes of any kind, or(iii) use the Website and / or Services in any way that is unlawful, or harms INOX JEWELRY INDIA or any other person or entity, as determined in the INOX JEWELRY INDIA's sole discretion. 1. Collect or store personal data about any other users in connection with the prohibited conduct and activities set forth in paragraphs(a) through (l) above.

6.2  You acknowledge and agree that INOX JEWELRY INDIA may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:  

1. comply with legal process; 

1. enforce the User Agreement; 

1. respond to claims that any Content violates the rights of third-parties; 

1. respond to your requests for customer service; or
2. protect the rights, property, or personal safety of INOX JEWELRY INDIA, its users and the public.

6.3  You understand that the technical processing and transmission of the service, including your Content, may involve:  

1. transmissions over various networks; and 

1. changes to conform and adapt to technical requirements of connecting networks or devices.

6.4 Where any part of the Service involves or is provided by us in conjunction with a third party, you agree to comply with any notices, instructions or directives given by such third party in relation to such part of the Service, including your access to or use thereof. 

7. CONDITIONS OF SALEThese Conditions of Sale govern the sale of products by INOX JEWELRY INDIA to you. Please read these conditions carefully before placing an order with INOX JEWELRY INDIA. By placing an order with INOX JEWELRY INDIA, you signify your agreement to be bound by these conditions. 

7.1 OUR CONTRACT Your order is an offer to INOX JEWELRY INDIA to buy the product(s) in your order. When you place an order to purchase a product from INOX JEWELRY INDIA, we will send you an e-mail confirming receipt of your order request and containing the details of your order (the "Order Confirmation E-mail"). The Order Confirmation E-mail is acknowledgement that we have received your order, and does not confirm acceptance of your offer to buy the product(s) ordered. We only accept your offer, and conclude the contract of sale for a product ordered by you, when we dispatch the product to you and send e-mail confirmation to you that we've dispatched the product to you (the "Dispatch Confirmation E-mail"). If your order is dispatched in more than one package, you may receive a separate Dispatch Confirmation E-mail for each package, and each Dispatch Confirmation E-mail and corresponding dispatch will conclude a separate contract of sale between us for the product(s)specified in that Dispatch Confirmation E-mail.  

7.2 MODES OF PAYMENT All payments must be received by us prior to shipping unless the order is placed by using Cash on delivery (COD) payment mode. We accept payment by check/cash/draft, net-banking, credit card, debit card, cash card, and mobile payments. All items purchased from the Site must be paid in full and funds verified before the item will be delivered. Payment can be made by using your credit card or you may mail us a check to the address listed below, before awaiting the shipment. Please note check payments are subject to clearance. 

7.3 CANCELLATION 

1. Cancellation by INOX JEWELRY INDIA: There may be certain orders that INOX JEWELRY INDIA is unable to accept and must cancel. INOX JEWELRY INDIA reserves the right, at INOX JEWELRY INDIA's sole discretion, to refuse or cancel any order for any reason whatsoever. Some situations that may result in your order being canceled include, without limitation, non-availability of the product or quantities ordered by you, non- availability of the service, inaccuracies or errors in pricing information, or problems identified by INOX JEWELRY INDIA's credit and fraud avoidance department. INOX JEWELRY INDIA may also require additional verifications or information before accepting any order. INOX JEWELRY INDIA will contact you, if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit/debit card has been charged, the said amount will be reversed back in your credit/debit card account. INOX JEWELRY INDIA will notify you of any order cancellations within 7 Business Days.
2. Cancellation by the Customer: In case of requests for order cancellations, please inform INOX JEWELRY INDIA as soon as possible. INOX JEWELRY INDIA reserves the right to accept or reject requests for order cancellations for any reason whatsoever. As part of usual business practice, if INOX JEWELRY INDIA receives a cancellation notice and the order has not been processed/ approved by INOX JEWELRY INDIA, INOX JEWELRY INDIA shall cancel the order and refund the entire amount to you within a reasonable period of time. INOX JEWELRY INDIA will not be able to cancel orders that have already been processed. INOX JEWELRY INDIA has the full right to decide whether an order has been processed or not. You agree not to dispute the decision made by INOX JEWELRY INDIA and accept INOX JEWELRY INDIA's decision regarding the cancellation.

7.4 RETURNS INOX JEWELRY INDIA offers 14 days replacement guarantee for all products sold on the Site, under certain conditions which are mentioned below: 

1. You will notify us of any damage or defect within 72 hours from the date of receipt of delivery of the products. In case you fail to inform INOX JEWELRY INDIA within the stipulated time frame, INOX JEWELRY INDIA reserves the right to accept or reject such request at its discretion. INOX JEWELRY INDIA will replace the defective product with a brand-new product at no extra cost.

1. INOX JEWELRY INDIA will try to replace the specific product ordered. However, the company reserves the right to offer an alternate product in case the product is out of stock/production.

1. The 14 days replacement guarantee is valid only in cases of manufacturing defects or transport damages for a product that does not comply with the specifications as per your original order. The claim is not valid and cannot be availed in cases of damages due to normal wear & tear or negligence.
2. INOX JEWELRY INDIA does not take title to returned items until the items arrive at the returns address destination. At our discretion, a refund may be issued without requiring a return. In this situation, INOX JEWELRY INDIA does not take title to the refunded item.

7.5 PRICING AND AVAILABILITY 

1. All prices are inclusive of legally applicable GST.

1. We list availability information for products sold by us on the website including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. As we process your order, we will inform you by e-mail or phone as soon as possible if any products you order turn out to be unavailable and you will not be charged for those products.

1. Please note that unless otherwise stated on the website, delivery estimates are just that. They are not guaranteed delivery times and should not be relied upon as such.

1. Despite our best efforts, a small number of the items in our catalogue may be wrongly priced. We will verify pricing when processing your order and before we take payment. If we have made a mistake and a product's correct price is higher than the price on the website, we may either contact you before shipping to request whether you want to buy the product at the correct price or cancel your order. If a product's correct price is lower than our stated price, we will charge the lower amount, refund the difference, and send you the product.

7.6 PRODUCT INFORMATION 

1. Unless expressly indicated otherwise, INOX JEWELRY INDIA is not the manufacturer of the products sold on this website. While we work to ensure that product information on our website is correct, actual product packaging and materials may contain more and different information to that displayed on our website. All information about the products on our website is provided for information purposes only. We recommend that you do not rely solely on the information presented on our website. Please always read labels, warnings and directions provided with the product before use.

1. The weight of the product as mentioned may vary slightly due to the nature of the article.

1. INOX JEWELRY INDIA accepts no liability for inaccuracies or misstatements about products by manufacturers or other third parties. This does not affect your statutory rights.

1. Some items may appear slightly larger or smaller than actual size due to screen defaults and photography techniques. Sometimes the items may be represented larger than the actual size in order to clearly show details or smaller than the actual size in order to show the entire item.

7.7 CERTIFICATE & WARRANTY All INOX JEWELRY INDIA products come with a one year manufacturer’s warranty against manufacturing defects. Please save the original invoice or email from Shashvi Agencies Pvt. Ltd. - INOX JEWELRY INDIA and/or hard copy for verification in the event for using warranty coverage. If the original product is out in stock, and the product is eligible for warranty coverage, INOX JEWELRY INDIA will replace with a similar product based on monetary value as per original invoice at time of purchase. The warranty does not cover normal wear and tear over the one year period. Warranty does not cover any product(s) that are lost or stolen after receipt to customer from INOX JEWELRY INDIA. A maximum of (1) one time over a one-year period can the warranty coverage be accessed and INOX JEWELRY INDIA has the right to accept or reject a claim on the coverage for a product. 

7.8 INSURANCE Transit insurance shall be provided by INOX JEWELRY INDIA and the same shall be valid only until the time of delivery at your designated delivery address. 

7.9 SPECIAL OFFERS INOX JEWELRY INDIA will run special offers and promotions from time to time. In the event of a special offer or promotion, all items are final sale and are ineligible for returns and/or exchanges. 

7.10 COMMUNICATION CONSENT AND PREFERENCES

a. Voluntary Opt-In for Communication: By providing your contact details, including but not limited to your email address, phone number, and postal address, you voluntarily opt-in and consent to receive communications from INOX JEWELRY INDIA. These communications may include, but are not limited to, responses to any queries you may have submitted, additional information required for order processing, and various marketing communications.

b. Modes of Communication: The communications from INOX JEWELRY INDIA may be conveyed through various channels such as phone calls, emails, mail, SMS, social media platforms, and other messaging applications.

Furthermore, you may also request the erasure of your personal data by contacting inox@shashvi.in for the same. Upon such a request, INOX JEWELRY INDIA will take necessary steps to comply with your preferences and remove your information from our communication lists and databases in a timely manner, subject to any legal or regulatory requirements for data retention.

You acknowledge and agree that the Site/ service and any necessary software used in connection with the Site/ service ("Software") contain proprietary and confidential information of INOX JEWELRY INDIA and that it is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by us, you agree not to modify, adapt, rent, lease, loan, sell, distribute or create derivative works based on the Service, the Software or the Content (excluding Content owned by you), in whole or in part.
